These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Andes Nest Hotel & Spa ("we," "us," or "our"), concerning your access to and use of the AndesNestHotel.com website, as well as your booking and stay at our physical property located in Chile. By accessing the website or making a reservation, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the site and our services.
All reservations are subject to availability. When you make a booking through our website, you will be required to provide accurate and complete personal and payment information. A reservation is only confirmed once you receive a confirmation email from us containing a valid booking reference number.
All rates displayed on our website are subject to change without notice prior to confirmation of a booking. Rates are quoted in United States Dollars (USD) or Chilean Pesos (CLP) depending on your selection. Foreign tourists visiting Chile may be exempt from the 19% Value Added Tax (IVA) on accommodation if payment is made in USD or by an international credit card, subject to presenting a valid passport and tourist card upon check-in. Failure to provide these documents will result in the 19% tax being added to your final bill.
A valid credit card is required to guarantee your reservation. We reserve the right to pre-authorize your credit card prior to arrival to ensure validity and sufficient funds. Full payment for your stay, along with an incidental deposit, will be required upon check-in.

Early check-in and late check-out requests are subject to availability and may incur additional charges. Guests must present a valid government-issued photo ID (or passport) and the credit card used for booking upon arrival.
You are liable for any damage howsoever caused to the allocated room(s) or to the hotel premises or property caused by you or any persons in your party. We reserve the right to retain your credit card details and charge your card for the appropriate amounts to cover the cost of repairing or replacing any damaged property.
Andes Nest Hotel & Spa is a strictly non-smoking property indoors. Smoking is only permitted in designated outdoor areas. A deep cleaning fee of $250 USD will be charged to any guest found to be smoking inside their room or other indoor public areas.
Guests must be at least 18 years of age to book a room. Furthermore, access to our private casino lounge is strictly restricted to adults aged 18 and older. Valid identification may be required for entry into the casino lounge. We promote responsible entertainment and reserve the right to refuse entry or service to any individual at our discretion.
While we love animals, pets are not allowed on the hotel premises, with the exception of certified service animals required for guests with disabilities. Please notify us in advance if you are traveling with a service animal.
Unless otherwise indicated, the website is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the website (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
To the fullest extent permitted by applicable law, Andes Nest Hotel & Spa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the website; (ii) any conduct or content of any third party on the website; (iii) any delays, cancellations, or disruptions to your travel arrangements outside of our direct control, including natural disasters or severe weather events in the Andes region.
These Terms shall be governed by and defined following the laws of the Republic of Chile. Andes Nest Hotel & Spa and yourself irrevocably consent that the courts of Santiago, Chile shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
